What is an Unpresented
Party in a Real Estate Transaction?
![]() |
An unrepresented party is a person who chooses not to sign an agreement for a real estate agent to represent them. This is called the Exclusive Right to Represent the Buyer/Tenant Agreement.
If you don’t sign this agreement, you are not a client. You are a customer. That means the agent works for someone else (like the seller or landlord), not for you. |
You won’t get help with advice, negotiation, or protecting your best interests. Even without signing the agreement, you’ll still need to sign the Understanding Whom Real Estate Agents Represent disclosure. This form helps you understand who the agent is really working for.
What Can a Real Estate Agent Do
for You if You’re Not Represented?
If you’re not represented, a real estate agent can only do basic tasks to help move the process along. These are called ministerial acts. They do not include giving you advice or helping you make decisions. Here are some examples of what they can do:
- Fill in the blanks on contract forms
- Help schedule inspections (like for the home or pests)
- Help you get in touch with a loan officer
- Share general information about loans and settlements
- Contact service providers if you ask them to
But remember, you must make all the decisions yourself. The agent cannot choose inspectors, give advice, or tell you what’s best for you.
When Are Ministerial Acts Allowed?
A real estate agent can only help with these small tasks if they have written permission from their real client, usually the seller or landlord.
Why Having Your Own
Agent Is a Smart Choice
If you don’t have your own agent, you’re on your own. No one is looking out for you. But when you sign the Exclusive Right to Represent the Buyer/Tenant agreement, the agent becomes your partner. They’ll help you:
- Understand contracts
- Ask the right questions
- Get a fair deal
- Stay safe from scams
- Make smart decisions
Having your own agent means someone is on your side, from start to finish.
