Below you will find many of the documents that we use for listing Maryland residential properties for rent.  You will also see the documents used for us to enter into a property management relationship with homeowners.  We have found that many companies don’t provide this information until after they schedule a meeting.  We believe that consumers can do some of their own research and then meet with us.  It usually makes the process move more quickly.  These documents are all legally-binding contract documents.  They were written and approved by either the Maryland Real Estate Commission (MREC), the Maryland Realtors ( the State Association) or one of the local real estate Boards or Associations.

real estate disclosuresUnderstanding Whom Real Estate Agents Represent.  This disclosure explains the role of all real estate agents in a transaction.  It is intended to be used by any tenant customer who is using a licensed real estate agent to find a rental home in Maryland.  If that customer does not sign an Exclusive Right to Represent the Buyer/Tenant Agreement, then they are an unrepresented party and should sign this disclosure.

real estate disclosuresConsent For Dual Agency.  This disclosure is used for some parties to a transaction.  It is used when the same Real Estate Brokerage Company (through two different real estate agents) is representing both the seller and buyer in a single transaction.  All of our home sellers sign this disclosure to allow us to adequately market their property.  It is required to be signed by a buyer who is represented by one of our licensed real estate agents through the Exclusive Right to Represent the Buyer/Tenant Agreement.

Rental Lease AgreementsExclusive Right to Lease Residential Brokerage Agreement.  This the brokerage agreement that authorizes DMS Properties, LLC Residential Real Estate Services to list a residential property for rent and market it to potential tenants.  The properties are marketed through Bright MLS and various real estate Internet sites.

Rental Lease AgreementsLock Box Addendum.  This addendum is used as part of the document package for homeowners who decide to lease their residential property in Maryland.  It is used when the homeowners authorize our licensed real estate agents to place a lock box on the property.  The lock box makes it easy for our agents and licensed real estates from other companies to show the home to potential tenants.  It is also used to allow access to the home by contractors who are making repairs through our Homeowner Concierge Service Program.

Rental Listing Document LibraryMaryland Lead Poisoning Prevention Program Disclosure.  This disclosure is required for all Maryland rental properties that were built BEFORE January 1, 1978.  The Maryland laws regarding rental properties and lead-based paint in the home are designed to eliminate the potential of poisoning from lead-based paint hazards in rental homes.

Document LibraryResidential Property Management Agreement.  This agreement is executed between DMS Properties, LLC Residential Real Estate Services and the owners of rental real estate.  It shows all of the services that we provide to landlords for managing their residential real estate.  It also outlines the duties and responsibilities of the property owners.

Property Management DocumentsDeed of Lease for Maryland. The Lease document is signed by both the owners of the rental property and the tenants that will be living in the home.  It provides all of the terms and conditions of the rental and is binding on both the tenants and the landlords.  This document is used in District Court of Maryland for Failure to Pay Rent or other actions. 

Property Management DocumentsProperty Condition Report.  This is the document that tenants complete at the beginning of their lease.  They will make notes of any deficiencies that they notice so that they are not charged for damages when they move out.  We use the report to evaluate the condition of the property when the lease ends.  The information helps determine what, if any, charges will be assessed against the tenants’ security deposit.

Property Management DocumentsAuthorized Agreement for Automatic Deposits (ACH Credits).  This document authorizes us to process distributions to the property owners through direct deposit to their preferred financial institution.  The form is accompanied by  a voided check from the owner’s bank to set up the direct deposit system.

Property Management DocumentsOwner’s Account Statement.  Each month when the homeowner distributions of rent proceeds is completed, we also send them an e-mail with their statement of account.  It shows all transactions (rent receipts, management fee, repair expenses, etc.) that occurred during the month.  Homeowners use these statements to monitor the activity at their rental home.  We also send out a full-year statement and the Form 1099 that they will use for filing their income tax returns each year. 

Property Management DocumentsLandlord’s Moving-Out Check List.  This document is provided to all homeowners when we start the process of listing a home for rent and/or beginning the management of the home.  It explains to the homeowners what they should do as they prepare to move out of the home (if occupied).  It also provides tips for making the home show well to potential tenants.

Property Management DocumentsTenant Move-Out Check List.  This document is given to all tenants at the start of their lease.  They are required to sign and date it as proof that it was given to them.  It is sent to them again when they provide notice that they will be vacating the home.  It outlines what must be done as they move out to expedite the return of their security deposit.

Document LibraryBusiness Directory.  We are compiling a list of licensed contractors, handymen and other service providers that we use.  They include accountants, attorneys, tax professionals, home cleaners, lawn maintenance vendors, title companies, and mortgage lenders.  They are all people trusted by DMS Properties, LLC Residential Real Estate Services. to take care of the properties that we own and the homes we manage for our clients.  If you need any type of service for your property, let us know and we will make the introductions for you.
