Pay the Last Month’s Rent?
Absolutely not. Under Maryland law, and as stated clearly in the Lease Agreement, a tenant may not use the Security Deposit as rent, nor may it be applied to the last month’s rent.
All security deposits must be held in escrow on behalf of the tenant. These funds are reserved strictly to cover damages, unpaid charges, or other obligations under the lease.
It’s also important to understand that a tenant’s responsibilities do not necessarily end when they move out. In some cases, required repairs may be substantial or may take longer than the 45-day period the landlord has to return the security deposit. If that happens, the landlord is permitted to pursue reimbursement from the tenant for any additional damages or costs beyond what the deposit covers.
